Actually, the patent covers SFN + LFN co-existing, and covers FAT12 the same as it covers the other FAT systems.

Regardless of what is used to boot Vista, virtually all devices that can be accessed directly in windows are Fatxx; USB flash, SD cards, MP3 players, etc.

FAT is still widely used, and ExFat will likely be used for these devices in the future. It makes sense to continue with it in DOS; support will be added in Linux/BSD, no doubt.
